DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY
River Limited ("River", "Company", "we", "us", or "our") respects the intellectual property rights of others and expects users of its website, applications, platforms, and services (collectively, the "Platform") to do the same. This Digital Millennium Copyright Act Policy ("DMCA Policy") sets out the procedures for submitting notices of alleged copyright infringement and counter-notifications in accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512).
Although River Limited is incorporated in Hong Kong, this DMCA Policy is adopted to provide a globally recognized copyright compliance framework for content hosted or transmitted through the Platform.
1. Scope of This Policy
This DMCA Policy applies to all content made available on or through the Platform, including user-generated content, uploaded materials, and third-party content hosted or displayed by River Limited.
2. Reporting Copyright Infringement
If you believe that any content on the Platform infringes your copyright, you may submit a written notification ("DMCA Notice") to River Limited’s designated contact. Your DMCA Notice must include all of the following information:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
Identification of the copyrighted work claimed to have been infringed, or a representative list of such works if multiple works are involved;
Identification of the material that is claimed to be infringing and sufficient information to locate the material on the Platform;
Your name, address, telephone number, and email address;
A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
Failure to include all required information may result in delays or inability to process your notice.
3. Takedown Procedure
Upon receipt of a valid DMCA Notice, River Limited may, at its discretion and where required by law:
Remove or disable access to the allegedly infringing material; and
Notify the user who posted or provided the content of the removal or restriction.
River Limited does not make determinations regarding ownership of content beyond the requirements of applicable law.
4. Counter-Notification
If you believe that content removed or disabled pursuant to a DMCA Notice was removed as a result of mistake or misidentification, you may submit a written counter-notification ("Counter-Notice"). A valid Counter-Notice must include:
Your physical or electronic signature;
Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed;
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
Your name, address, telephone number, and email address; and
A statement that you consent to the jurisdiction of the appropriate courts and that you will accept service of process from the person who submitted the original DMCA Notice or their authorized agent.
Upon receipt of a valid Counter-Notice, River Limited may forward it to the original complainant and, where permitted by law, restore the content unless legal action is initiated.
5. Repeat Infringers
River Limited reserves the right, in appropriate circumstances and at its sole discretion, to suspend or terminate accounts or access of users who are determined to be repeat copyright infringers.
6. Misrepresentations
Any person who knowingly materially misrepresents that content is infringing or was removed or disabled by mistake may be subject to liability under applicable laws.
